Gilgamesh was incarnated at the end of the last war. He’s not technically a servant at the moment. He’s flesh and blood. The fact he’s still as powerful as he is is a facet of who he is rather than what he is. The only difference is that he doesn’t have access to the grail’s mana supply so most of his abilities are too costly to use, in theory at least. Kotomine came up with a workaround for that during the last decade, though I think that’s information from the Visual Novel only.
I forgot why I was typing this. It was in response to your question about Shinji having command seals. As Gilgamesh isn’t technically a servant, they don’t have a binding pact via the grail and so Shinji doesn’t get command seals from the grail.
